Human Rights Organizations demand that the IACHR reject a coup in Venezuela

Through a signed declaration, a total of 60 organizations, social movements and jurists from around the world, categorically denounced the attempted coup in Venezuela on January 23, where the deputy of the National Assembly in contempt, Juan Guaidó proclaimed himself as interim President of the Bolivarian Republic of Venezuela, violating the provisions of the Venezuelan Constitution.

SIGNED DECLARATION

The human rights organizations, social movements, trade unions and associations of jurists from all over the world who signed below denounce the coup d’état in Venezuela on January 23, 2019, in which Juan Gerardo Guaidó, president of the National Assembly in contempt, self-proclaimed and swore in as “Acting President” of the Bolivarian Republic, violating the most basic principles of a rule of law, the Constitution and fundamentally the sovereign decision of a people that on May 20, 2018 expressed its will at the polls and where 9.389 .056 people democratically exercised their right to suffrage and President Maduro won with a wide margin, obtaining 6,248,864 votes, or 67.84%.

We are concerned about how this Commission grants a precautionary measure identified with number 70-19 in favor of Juan Gerardo Guaidó Márquez and the members of his family on January 25, 2019, being a person who has incited violence in the country, he has carried out a coup d’etat, and it does not follow up with the same speed for the requests that various organizations have been making regarding different situations that occur in Venezuela, such as the unilateral coercive measures dictated against the country, which have caused the suffering for the Venezuelan people. We are also concerned that the Commission is pronouncing a precautionary measure on a leader of the opposition to the Venezuelan government but does not pronounce itself condemning the coup d’état in Venezuela.

This Commission can not reissue the actions of the General Secretary of the OAS when in 2002 it did not recognize the coup d’état carried out by Pedro Carmona Estanga, President of the Fedecámaras employer association, against President Hugo Chávez, nor to legitimize the actions of the current General Secretary Luis Almagro, of recognizing an “interim president” in Venezuela, since it lacks constitutional foundations and is carried out in violation of the laws of the country, since it is not verified that none of the assumptions allow the president of the legislative body to temporarily assume the presidency of the country.

Members of the Inter-American Commission on Human Rights, we can not allow more State Coups in our continent, or legitimize irregular situations, in violation of the OAS Charter and human rights, just for not agreeing with the government of a country, or its rulers.

Therefore, we urge the Commission to adhere to the Charter of the Organization of American States and its mandate, to pronounce against the coup d’état in Venezuela, as it has done on other occasions in our continent, and to take an impartial action in accordance to international human rights standards and, consequently, to revoke the precautionary measure issued in favor of the Venezuelan politician Guaidó.
